These Terms of Use are a legally binding agreement between you and The Mainspring Group, LLC. They govern your use of the Builder Maturity Assessment platform at buildermaturity.com.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER.

1. Definitions

Service means the Builder Maturity Assessment platform at buildermaturity.com.

User / you means the individual or organization using the Service. You must be at least 18 years old.

Subscription means an online order for the Service accepted by Mainspring.

2. License and Use

Mainspring grants you a limited, revocable, nonexclusive license to access and use the Service in compliance with these Terms. Mainspring may modify, suspend, or terminate the Service at any time without notice.

3. The Builder Maturity Assessment Service

The Service helps residential homebuilders evaluate operational maturity and receive AI-powered recommendations.

Payment. Fees are based on pricing at time of Subscription. Payments are non-refundable once processed.

Cancellation. Cancel anytime through account settings. Access ends on the cancellation date.

Your Data. You retain ownership of your assessment data. Mainspring may use anonymized, aggregated data to improve the Service.

4. Intellectual Property

Mainspring owns all content including the maturity model, questions, scoring methodology, and software. You may not reproduce or distribute any content without written consent.

5. Account Security

Keep your credentials confidential. Notify us immediately of unauthorized access at hello@themainspringgroup.com.

6. Prohibited Uses

You may not violate third-party rights, provide false information, reverse engineer the Service, upload malicious code, impersonate any person, or use the Service unlawfully.

7. Privacy

All information is governed by our Privacy Policy.

8. Indemnification

You agree to indemnify Mainspring and its affiliates from any claims arising from your use of the Service or violation of these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED AS IS WITHOUT WARRANTIES OF ANY KIND.

10. Limitation of Liability

MAINSPRING SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

11. Disputes and Arbitration

Disputes resolved by binding arbitration in Philadelphia, PA under JAMS rules. CLASS ACTIONS NOT PERMITTED. Governed by Pennsylvania law.

12. Termination

We may terminate access at any time. You may terminate by emailing hello@themainspringgroup.com.
